Terms & Conditions

1. Who we are and when these Terms apply

These Terms govern inquiries, reservations and travel services arranged through Morocco Luxury Vacations. “We”, “us” and “our” mean Morocco Luxury Vacations, S.A.R.L - AU. “Traveler” and “you” include the lead booker and every person included in the reservation. The lead booker confirms that they are at least 18, have authority to act for the group, and will give these Terms and all travel information to each traveler.

Depending on the written confirmation, we may supply a service directly or arrange it through hotels, transport providers, guides, restaurants, activity operators and other independent suppliers. The confirmation identifies the booked services, price, payment schedule and any disclosed supplier-specific conditions. If a specific service has stricter conditions, they apply only when clearly disclosed before confirmation and only to that service.

2. Contract formation and confirmation

An inquiry, quote or checkout selection is not a confirmed booking. Stripe and PayPal reservations are created and confirmed only after the payment provider verifies successful payment. A failed, cancelled, disputed or expired online payment does not create a booking. Bank-transfer and eligible cash reservations are confirmed when our written confirmation is issued; their payment status remains awaiting transfer or unpaid until we record cleared funds.

You must check names, dates, services, prices and contact details immediately. Tell us promptly if anything is incorrect. We may correct an obvious pricing or description error before confirmation; if we discover a material error after confirmation, you may accept the corrected arrangement or cancel the affected service for a refund of the amount paid for it.

3. Prices, currency and payment

Prices are shown in the currency stated at checkout and include only the items listed as included. The booking may require a deposit or full payment. The confirmation states the balance and due date. Failure to pay on time may be treated as a traveler cancellation after we send a reasonable payment reminder.

You are responsible for bank, card-issuer and currency-conversion charges. Where lawful, documented taxes, government charges, transport/fuel costs or exchange-rate changes affecting the booked service may result in a price adjustment. We will explain the calculation. We absorb increases equal to 2% of the total booking price; if the total increase exceeds 8%, you may accept it or cancel the affected arrangements for a refund. Any more favorable mandatory right applies instead.

4. Traveler changes and transfers

Change requests must be made in writing. Availability, changed dates, room types, additional travelers and upgraded services can change the price. Our amendment rules, including one limited free date change, are in the Cancellation & Refund Policy.

You may ask to transfer a booking to another eligible traveler with reasonable notice. The replacement must accept these Terms and meet passport, visa, health and supplier requirements. You and the replacement traveler are jointly responsible for any unpaid balance and the actual, documented costs of the transfer. A supplier restriction that makes a transfer impossible will be explained.

5. Cancellation

Traveler cancellations are subject to the graduated fees, notice rules and limited flexibility set out in our Cancellation & Refund Policy, which forms part of these Terms. We strongly recommend comprehensive travel insurance covering cancellation, medical care, interruption, baggage and repatriation.

6. Changes or cancellation by us

Travel in Morocco can require itinerary adjustments because of weather, road conditions, closures, safety concerns or supplier changes. For a minor change, we may provide a reasonable substitute while protecting the character and value of the journey. If a confirmed service changes materially, we will offer, where reasonably available, a comparable alternative, an appropriate price reduction, or cancellation of the affected service with a refund.

If we cancel a service for reasons within our control, you may choose a suitable alternative or a refund of the amount paid for the cancelled service. Where mandatory law gives you additional rights—such as fee-free termination or a full refund after unavoidable and extraordinary circumstances significantly affect performance—those rights prevail.

7. Passports, visas, health and insurance

Travelers are responsible for valid passports, visas, entry and exit requirements, vaccinations, insurance and any health formalities applicable to their nationality and itinerary. General information from us is not legal or medical advice. Tell us before booking about mobility, accessibility, dietary, allergy or medical needs relevant to safe service delivery. We will make reasonable efforts to assist but cannot guarantee an accommodation unless confirmed in writing.

8. Conduct, safety and local rules

Travelers must follow reasonable safety instructions, respect local law and customs, and avoid conduct that risks people, property or the journey. A supplier may refuse or end a service where a traveler’s conduct, intoxication or non-compliance creates a material safety or disruption risk. No refund is due for services lost because of the traveler’s serious misconduct, without limiting any mandatory right.

9. Complaints and assistance

Report a problem as soon as possible to the guide, supplier or our support contact so it can be investigated and, where possible, corrected during the journey. Send any unresolved complaint within 14 days after the affected service, with the booking reference, facts and supporting documents. A delay does not remove a mandatory right, but may limit our ability to verify or remedy the issue.

10. Responsibility and liability

We exercise reasonable care in selecting and arranging services. Independent suppliers remain responsible for performing their services, subject to our obligations under applicable law. To the extent permitted by law, we are not liable for losses caused by the traveler, an unrelated third party, or unavoidable and extraordinary circumstances that could not reasonably have been avoided.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, willful misconduct, gross negligence, or any liability or consumer remedy that cannot legally be excluded. International transport conventions and mandatory statutory limits may apply. Where lawful, we do not cover indirect or unforeseeable business losses arising from a consumer booking.

11. Unavoidable and extraordinary circumstances

These may include severe weather, natural disaster, epidemic, conflict, government restriction, border closure, serious security event or major transport disruption beyond the affected party’s reasonable control. We will communicate promptly, prioritize safety and seek proportionate alternatives. Refund and termination rights will follow the Cancellation & Refund Policy and any mandatory law.

12. Website content, reviews and intellectual property

Website photographs, text, branding and itineraries are protected and may not be commercially reproduced without permission. Descriptions and images are illustrative; seasonal or local conditions can change. Reviews may be moderated for authenticity, privacy, abuse, spam and relevance. “Verified booking” means the review link matched a booking in this system; it is not an endorsement of the review’s content.

13. Privacy and electronic communications

Our Privacy Policy explains how personal information is used and shared. You agree that confirmations, invoices, notices and support communications may be delivered electronically to the contact details supplied. Keep those details current and check spam folders.

14. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Morocco. Please contact us first so we can seek an amicable solution. If a dispute cannot be resolved, the competent courts of Casablanca may hear it where the law permits. This choice does not deprive a consumer of non-waivable rights or the protection of a mandatory law or forum that otherwise applies in their country of residence.

15. General provisions

If any provision is invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. The confirmation, these Terms, the Cancellation & Refund Policy, the Privacy Policy and any pre-confirmation supplier terms form the complete booking agreement. We may update these Terms for future bookings; the version accepted when your booking is confirmed applies unless a change is required by law or expressly agreed.
